The Pennsylvania Labor Relations Board (PLRB) on April 6 held a conference call in relation to Penn State graduate students seeking to unionize with attorneys representing the Pennsylvania State Education Association (PSEA) and Penn State. This call is required under the PLRB rules to identify issues that require a hearing before the PLRB can determine if an election should be held.
In this case, the PLRB will hold hearings to determine whether Penn State graduate students are employees within the meaning of the Pennsylvania Employe Relations Act (PERA) and also whether certain graduate students will be included within any potential unit under Pennsylvania law. The PLRB has scheduled the hearings for September 5, 6, 7, 8, 11, 12, and 13, 2017.
The PLRB, not Penn State nor PSEA, sets the hearing dates and controls the hearing process. At this point, the PLRB has not determined whether an election is appropriate. The PLRB will not order an election unless it determines that there is an appropriate unit under the law. If an election is ordered, the PLRB, not Penn State, will set the date of the election and control the election process.
